SMS Texting Terms and Conditions

Wysh operates three mobile messaging programs (the “Programs” and each, a “Program”) that are subject to these Messaging Terms and Conditions (“Messaging Terms”). The Programs and Wysh’s collection and use of your personal information is also subject to our Privacy Policy (available at: https://www.wysh.com/l/privacy-notice). By enrolling, signing up, or otherwise agreeing to participate in a Program, you accept and agree to these Messaging Terms, to the extent applicable to the Program in which you have agreed to participate, and our Privacy Policy.
Authentication Program
Wysh will send you an SMS message with a two-factor authentication code when you sign up for an account with Wysh and every time you attempt to log into either the Wysh mobile application or the Wysh website. Authentication SMS messages will be sent from short code 61213.
Payment Alert Program
While you have an active policy, Wysh will send you text messages with payment reminders and to alert you to missed payments and potential policy lapse to help you keep your policy active. Payment SMS messages will be sent from telephone number (414)-441-9416.
Marketing Program
Wysh may send you SMS messages that advertise and promote our products and services if you have opted into the Marketing Program by providing to Wysh both your mobile number(s) and your consent to receive such messages. Marketing SMS messages will be sent from telephone number (414) 441-9540.
Acceptance
By providing your mobile phone number(s) to Wysh, you:
- accept these Terms and Conditions in their entirety;
- represent that you are the owner and/or an authorized user of the wireless device and associated telephone number that is used to receive SMS messages from Wysh or have been granted permission by the wireless service plan subscriber or authorized user of the wireless device and associated telephone number to enroll the number in the Wysh SMS-messaging service;
- expressly consent to receive SMS messages from Wysh at the enrolled telephone number, even if (i) the number is on a company, state, or national Do-Not-Call registry and (ii) the messages are delivered using an automatic telephone dialing system or automatic texting system;
- understand that, for the Authentication Program, you will receive one (1) message per request and that, for the Marketing Program, message frequency will vary but will not exceed 5 messages per 30-day period;
- may revoke your consent to, or opt-out of, receiving messages from Wysh at any time (by replying STOP to the short code or telephone number of the Program for which you intend to revoke your consent) in which case Wysh will send you an SMS message to confirm that you have been unsubscribed;
- understand that, if you are experiencing issues with the Wysh SMS-messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at 1-844-WYSH-HLP (844) 997-4457) Monday through Friday, 9 a.m. to 5 p.m. ET, excluding holidays, or by email at help@wysh.com; and
- acknowledge that consenting to receive SMS messages is not a condition to purchase any goods or services.
Pricing
Message and data rates may apply. Although Wysh does not charge a fee for the SMS-messaging service, you remain responsible for any and all charges, including, but not limited to, fees associated with text messaging imposed by your wireless carrier. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Changes
Wysh may modify or terminate its SMS-messaging service from time to time, for any reason and without notice, without liability to you or any third-party. Your continued use and acceptance of text messages from Wysh after changes are made to the Terms and Conditions will be deemed acceptance of the Terms and Conditions, as modified by the posted changes. Therefore, please check these Terms and Conditions on a regular basis.
Revocation
To revoke your consent by texting STOP to the text message you have received, your text response should contain only the word STOP without any additional words, spaces or characters either before or after the word STOP. This will opt you out of the text message type to which you have responded. Wysh will reasonably attempt to comply with other text communications sent in which you indicate a clear and unmistakable intent to revoke your prior permission; however, you understand that (a) Wysh’s SMS-messaging system is entirely automated (is not monitored by a human), and the ability of our short code box to interpret your intent is severely restricted and, therefore, (b) unless you reply only with the word STOP, your intent to revoke your prior express permission may not be effective.
Limitation of Liability
Wysh makes no representations or warranties whatsoever regarding SMS/text messages or this service which is provided on an “as is” and “as available” basis, without express or implied warranties of any kind. To the maximum extent permitted by applicable law, you hereby agree that Wysh shall not be liable for any direct, indirect, consequential, special, incidental, punitive or any other damages, even if Wysh has been advised of the possibility of such damage or loss, arising or resulting from or in any way relating to your use of Wysh text messages. The wireless carriers are not liable for delayed or undelivered messages. Furthermore, Wysh shall not be liable for the acts or omissions of third parties, including but not limited to delays in the transmission of messages.
Governing Law
Wysh’s SMS-messaging service is available only in the United States. These Terms and Conditions are governed by the laws of the State of Wisconsin, and any arbitration or judicial proceedings to enforce or interpret these Terms and Conditions may be brought only in the State of Wisconsin.
